Terms and Conditions for the use of the Platform
- The purpose and objectives of the Platform
- The Platform offers information to help individuals locate and connect with healthcare professionals.
- The Platform sources information about healthcare practices, surgeons, doctors, and other medical professionals providing health-related services in Australia:
- to promote referrals from GPs and other medical professionals and to provide representation to women in the medical surgical profession;
- to provide support and information to women in the medical surgical profession;
- to represent, advocate for and promote the interests of women in the medical surgical profession;
- to provide opportunities for the development and advancement of women in the medical surgical profession.
- Scope of Service
- Women In Scrubs is not a healthcare provider. The Platform serves as an intermediary, facilitating connections between patients and Practices.
- We do not guarantee that a Practice or healthcare professional selected by you will be available or will be able to address your medical needs.
- While we take reasonable steps to ensure accuracy in the information provided about Practices, we do not guarantee its completeness or accuracy. Where errors are reported, we will update the information after reasonable efforts to verify the error.
- The medical content on the Platform is for informational purposes only and should not replace professional medical advice. You acknowledge that you will not rely on this information for medical decisions.
- We do not independently verify the qualifications, credentials, or suitability of any healthcare providers or Practices listed on the Platform. You are responsible for conducting your own due diligence before engaging with any Practice.
- Use of the Platform
- You must not: a) Impersonate others or misrepresent affiliations; b) Use the Platform for deceptive or illegal activities; c) Interfere with the Platform’s functionality or security; d) Use automated means to access or scrape data from the Platform; e) Reverse engineer, modify, or create derivative works from the Platform; f) Post false, misleading, defamatory, or offensive content; g) Transmit viruses, malware, or other harmful elements; h) Engage in excessive or disproportionate use of Platform resources; i) Submit sensitive health information unless required for booking purposes.
- Third-Party Content and Links
- The Platform may contain third-party content and links to external websites. We do not endorse or control these third-party sites and are not responsible for their content or practices.
- You acknowledge that external websites may have their own terms and conditions, and you agree to review and comply with them separately.
- Privacy and Data Security
- By using the Platform, you acknowledge that we collect, store, and process your personal information in accordance with our Privacy Policy.
- We may collect personal data such as your name, email address, phone number, and browsing activity. We use this data to provide and improve our services, monitor user engagement, and comply with legal obligations.
- We use cookies and similar tracking technologies to monitor usage and enhance user experience. You can manage your cookie preferences through your browser settings.
- While we take reasonable measures to secure your data, you acknowledge that the internet is not entirely secure and that there are inherent risks associated with transmitting data online.
- You agree to notify us immediately if you suspect any security breach related to your account or personal information.
- You are responsible for ensuring that any device you use to access the Platform is secure and protected from potential threats, including malware and unauthorised access.
- Liability and Indemnity
- To the fullest extent permitted by law, Women In Scrubs excludes all liability for any direct, indirect, incidental, consequential, or special loss or damage arising from your use of the Platform.
- You agree to indemnify us against any claims, losses, or damages arising from your use of the Platform, your breach of these Terms and Conditions, or any interactions with Practices.
- We make no warranties regarding the availability, accuracy, or reliability of the Platform or its services and disclaim all implied warranties to the maximum extent permitted by law.
Terms and Conditions for membership
By applying for a membership on the Platform you agree to the terms and conditions outlined in this document.
The following terms also apply to your membership:
(a) the terms of use for any websites or mobile apps covered by your membership;
(b) our Privacy Policy (https://www.womeninscrubs.com.au).
1. Interpretation
In these terms:
- Activation Date – means the date that we notify you in writing that we have accepted your membership or the date that we first provide you with member access to the Platform, whichever occurs first.
- Fees – means the fees set out in clause 5, as amended from time to time pursuant to clause 9.
- GST – means the tax payable on taxable supplies under the GST Law.
- GST Law – has the meaning given to that term in the A New Tax System (Goods and Services Tax) Act 1999 (Cth) and includes any related Act imposing such tax, and includes any subordinated legislation in respect of those Acts to the extent not otherwise including in that meaning.
- Member (‘you’/’your’) means a subscriber to the Platform.
- Membership Term means the duration of the Member’s subscription to the Platform, which starts on the Activation Date and ends on termination of this agreement pursuant to clause 8.
- Platform means the website and any other online portals, databases and applications maintained by Women in Scrubs.
- Terms means these terms and conditions, as changed from time to time.
- Women in Scrubs (‘we’/‘us’) means Women in Scrubs Pty Ltd ACN 682 426 686.
2. The purpose and objectives of the Platform
- The Platform offers information to help individuals locate and connect with healthcare professionals.
- The Platform sources information about healthcare practices, surgeons, doctors, and other medical professionals providing health-related services in Australia:
- to promote referrals from GPs and other medical professionals and to provide representation to women in the medical surgical profession;
- to provide support and information to women in the medical surgical profession;
- to represent, advocate for and promote the interests of women in the medical surgical profession;
- to provide opportunities for the development and advancement of women in the medical surgical profession.
3. Eligibility for membership on the Platform
- The following eligibility criteria applies to membership on the Platform. The members must:
- Be a female/woman as identified in the Australian Health Practitioner Regulation Agency profile; and
- Hold the relevant professional medical qualifications for the applicable member category as specified by the Platform from time to time; and
- Have a current medical practice in Australia; and
- Be registered with Australian Health Practitioner Regulation Agency; and
- Provide identity documents and complete a proof of identity check as specified by the Platform from time to time; and
- Agree to abide by and comply with these Terms
4. Membership application
- An application for membership of the Platform must be submitted in writing or by electronic means in the form approved by Women in Scrubs.
- Women in Scrubs will consider the application for membership within 5 business days of the receipt of the completed membership form together with relevant identification documents.
- Women in Scrubs may request such further information or documents from the applicant as are necessary to verify information provided in the membership application form.
- Women in Scrubs may reject any membership application, where the applicant:
- does not meet the eligibility for membership on the Platform pursuant to these Terms; or
- does not provide such additional information or documents as requested for assessment of the membership application within 5 business days of the request.
- Women in Scrubs must as soon as practicable after making the decision whether to accept or reject an application, give the applicant a written notice of the decision.
5. Fees, payments and refunds
- You agree to pay us the Fees for each Membership Term, payable:
- in advance; or
- in such increments as we may allow from time to time by agreement with you.
- All Fees are non-refundable, except that a refund of the Fees paid is available:
- where required by law; or
- when a member serves written notice to us terminating this agreement and requesting a refund at any time within 10 business days of the Activation Date of the membership.
- You must ensure that the payment method provided at the time of membership application remains a current and accepted method of payment. It is your responsibility to update relevant payment details on the Platform to avoid any dishonour fees that may be charged by a financial institution. We reserve our right to oncharge any such fees to your account.
- Certain payments methods may result in further fees charged by the issuer relating to the processing of your payment. Payments made by credit card may incur a third-party surcharge fees payable by you at the rate specified at the time of payment and as such are subject to change without notice.
- Unless we state otherwise, all Fees exclude GST.
- We will issue an annual tax invoice to you with respect to a taxable supply made under this agreement no later than 14 days following payment of the GST inclusive consideration for that supply.
- If either party is entitled under this agreement to be reimbursed or indemnified by the other party for a cost or expense incurred in connection with this agreement, the reimbursement or indemnity payment must not include any GST component of the cost or expense to the extent that the cost or expense is the consideration for a creditable acquisition made by the party being reimbursed or indemnified, or by its representative member.
- If any amounts are owing to us by you or any third party on your behalf in connection with this agreement, we are entitled to recover from you or any such third party any costs, fees, disbursements or penalties properly incurred by us with respect to any debt collection or legal proceedings upon the indemnity basis.
6. Automatic membership renewals
- If you pay us the applicable Fees, we will create and maintain your profile on the Platform and provide you with access to the Platform during the Membership Term as set out in this agreement.
- We will provide you with a membership renewal reminder 30 days prior to the anniversary of the Activation Date. If you do not terminate your membership in accordance with clause 8(a)(i) your membership will be automatically renewed annually on the anniversary of the Activation Date.
7. Membership suspension, cancellation or termination
- We may limit, suspend or cancel your membership or your access to the Platform without notice to you if:
- you fail to pay Fees in accordance with this agreement, and fail to remedy that failure within 10 business days after the date of a notice from us specifying the amount overdue;
- you are otherwise in breach of this agreement, and you do not remedy your breach within 10 business days of the giving of our notice to you;
- your access or use of a Platform becomes unlawful; or
- we reasonably believe that, in the course of using the Platform, you have breached a person’s rights (including intellectual property rights) or any law.
8. Termination
- This agreement commences on the Activation Date and continues until:
- you terminate this agreement at any time by giving us 30 days written notice sent to info@womeninscrubs.com.au or
- we terminate this agreement immediately by notice in writing if you breach any term of this agreement that is not capable of remedy pursuant to clause 7(b)(i).
- Upon termination of this agreement, you will not be entitled to receive any refund of any part of Fees paid by you under this agreement, except in relation to non-excludable obligations, or as set out in clause 5(b).
9. Intellectual property
- By uploading any images or other documents to the Platform, you grant us a non-exclusive, royalty-free, worldwide licence to use and distribute the content across the Platform and any associated websites, social media, newsletters, and promotional campaigns. You are responsible for having the rights to any material uploaded.
10. Our right to change Platform
- We reserve the right to modify the Fees, content, inclusions, type and availability of the Platform and membership options at any time. In the event your membership materially changes (including changes to Platform access or Fees) we will provide you with a prior 30 days’ notice.
- We reserve the right from time to time to enable free or discounted memberships or access to our Platform for a limited period of time. During this time, you will not be eligible for a refund or credit.
11. General provisions
- The details in your membership application form part of these Terms and together are binding.
- Your membership is personal and not transferable for any reason. You must not rent, lease, assign, transfer, loan or otherwise distribute your membership or your member access to the Platform to any party.
- By its nature, the internet is not uninterrupted or error-free, and so there may be times when the Platform is unavailable or does not work properly due to technical difficulties. We cannot guarantee that the Platform:
- will be available or working correctly at all times.
- will be free from computer viruses or other defect or error which may affect your software or systems. To protect your software and systems we suggest you install and implement your own system protection software.
- If any provision of these Terms is invalid under the law of any jurisdiction the provision is enforceable in that jurisdiction to the extent that it is not invalid, whether it is in severable terms or not. This does not apply where enforcement of the modified provision would materially affect the nature or effect of the parties’ obligations under these Terms.
- Any changes to these Terms other than changes pursuant to clause 9 will be invalid unless agreed by all parties in writing and signed.
- The law of Queensland applies to this agreement, and the parties to this agreement irrevocably submit to the exclusive jurisdiction of the courts of Queensland.
